The McKinney-Vento Homeless Assistance Act was developed to aid homeless persons. I have provided a description of who is homeless as well as their rights pertaining to education. Please feel free to contact me with any questions or concerns you may have. Please contact your school’s guidance counselor if you feel any of your child(ren) are in need of Homeless services.

The McKinney-Vento Act defines “homeless children and youth” as individuals who lack a fixed, regular, and adequate nighttime residence. The term includes –
  • Children and youth who are:
    • sharing the housing of other persons due to loss of housing, economic hardship, or a similar reason (sometimes referred to as doubled-up);
    • living in motels, hotels, trailer parks, or camping grounds due to lack of alternative adequate accommodations;
    • living in emergency or transitional shelters;
    • abandoned in hospitals; or
    • awaiting foster care placement;
  • Children and youth who have a primary nighttime residence that is a public or private place not designed for, or ordinarily used as, a regular sleeping accommodation for human beings;
  • Children and youth who are living in cars, parks, public spaces, abandoned buildings, substandard housing, bus or train stations, or similar settings.
  • Migratory children who qualify as homeless because they are living in circumstances described above.

Rights of a Homeless Student
  • Receive a free, appropriate public education.
  • Attend their school of origin or school of current residence.
  • Remain in their chosen school for the duration of the homelessness or the remainder of the academic year if they become permanently housed during an academic year.
  • Immediate Enrollment
  • Transportation
  • Immediate access to educational services for which the student is eligible (Title I, Special Education, before and after school programs, vocational and technical education for gifted programs)
  • Free meals provided by the district through federal, state, or local food programs.
  • Appeal educational placement decisions made by the district.
  • Attend the student’s school of choice pending resolution of enrollment disputes.
